Terms and Conditions of Use and Sale

1. Purpose

These general conditions govern the use of the TAMSIV mobile application and the tamsiv.com website (hereinafter “the Service”). By using the Service, you accept all of these conditions.

2. Service Description

TAMSIV is a task, memo, and event management application featuring an AI-powered voice assistant. The Service notably allows for:

• The creation and management of tasks, memos, and calendar events
• Voice interaction with an AI assistant to create content
• AI-powered image generation
• Organization into binders and categories
• Group collaboration (sharing tasks and memos)
• Social features (comments, reactions, friends)
• A gamification system (points, badges, levels)

3. Registration and User Account

Access to the Service requires creating an account with a valid email address. The user agrees to provide accurate information and keep it up to date.

The user is responsible for the confidentiality of their login credentials. Any activity carried out from their account is deemed to have been performed by them.

The user must be at least 16 years old to create an account, in accordance with GDPR. For users under 16, consent from a legal guardian is required.

4. Subscriptions and Pricing

The Service offers several plans:

• Free Plan: access to basic features with usage limits (voice conversations, AI images, storage)
• Pro Plan: increased limits and advanced features
• Team Plan: extended collaborative features and high limits

Prices are displayed inclusive of all taxes (TTC) on the Pricing page of the website and in the application. They may be modified at any time, with current subscriptions remaining at the subscribed rate until their expiration.

4.1 Payment

Paid subscriptions are managed exclusively via the Google Play Store (Android) and Apple App Store (iOS) platforms. No credit card data is collected or stored by TAMSIV. Payment conditions are those of the platform used.

4.2 Automatic Renewal

Subscriptions are automatically renewed at the end of each billing period, unless terminated by the user before the renewal date, directly from their Google Play or App Store account settings.

4.3 Right of Withdrawal

In accordance with European Directive 2011/83/EU, you have a period of 14 days from the date of subscription to exercise your right of withdrawal, without giving any reason or incurring any penalty. To exercise this right, please contact us at: contact@tamsiv.com

5. Use of the Service

The user agrees to use the Service in compliance with applicable laws. The following are notably prohibited:

• Using the Service for illegal, fraudulent, or harmful purposes
• Publishing illicit, defamatory, hateful content, or content infringing on the rights of others
• Any attempt at unauthorized access to other users' systems, accounts, or data
• Misuse of the AI assistant (generating illicit content)
• Counterfeiting, decompiling, or reverse engineering the software
• Sharing one's account with third parties

TAMSIV reserves the right to suspend or delete any account in case of violation of these terms, after prior notification, except in urgent cases.

6. User Content

The user retains full intellectual property rights over the content they create (tasks, memos, files, comments). By using the Service, the user grants TAMSIV a limited, non-exclusive, and non-transferable license to host, display, and transmit this content as part of the Service's operation.

Content shared within groups is accessible to members of the relevant group. The user is responsible for the content they share.

7. Artificial Intelligence

The Service integrates artificial intelligence features (voice assistant, image generation). The user is informed that:

• AI responses are automatically generated and may contain inaccuracies
• Voice conversations are transcribed into text and then processed by a language model. Audio recordings are not stored after transcription
• Images generated by AI are provided for personal use within the scope of the Service
• Conversation history is limited to 20 messages and is not permanently stored

TAMSIV cannot be held responsible for content generated by artificial intelligence. The user remains solely responsible for their use of such content.

8. Intellectual Property

The TAMSIV application, its source code, interface, logos, texts, and design are the exclusive property of the publisher and are protected by intellectual property laws. Any reproduction, even partial, is prohibited without prior written authorization.

9. Service Availability

TAMSIV strives to ensure optimal Service availability (99.9% target). However, the Service may be temporarily interrupted for maintenance, updates, or in cases of force majeure.

TAMSIV does not guarantee uninterrupted operation and cannot be held responsible for damages resulting from temporary unavailability of the Service.

10. Limitation of Liability

The Service is provided "as is." TAMSIV cannot be held responsible for:

• Indirect damages, including loss of data, revenue, or opportunities
• Content generated by artificial intelligence
• Service interruptions beyond its control
• Non-compliant use of the Service by the user

TAMSIV's total liability is limited to the amount paid by the user during the 12 months preceding the event in question.

11. Termination

The user can delete their account at any time from the application settings. Deletion results in the permanent erasure of all personal data and content, in accordance with our privacy policy.

In the case of an active paid subscription, the subscription must be terminated separately from the Google Play Store or App Store. Account deletion does not automatically terminate the subscription.

12. Modification of Terms

TAMSIV reserves the right to modify these terms at any time. Users will be informed of any substantial changes by in-app notification or email at least 30 days before they take effect. Continued use of the Service after this date constitutes acceptance of the new terms.

13. Mediation and Dispute Resolution

In case of a dispute, the user is invited to contact customer service at contact@tamsiv.com to attempt to resolve the dispute amicably.

In accordance with European law, the user can freely use the mediation service of their choice. The European online dispute resolution platform is accessible at: https://ec.europa.eu/consumers/odr

14. Applicable Law

These terms are governed by the law of the European Union and the national law of the publisher's country of registration. In the event of a dispute, the competent courts will be those of the publisher's registered office, without prejudice to the mandatory legal provisions of the user's country of residence.

For consumers residing in the European Union, the mandatory consumer protection provisions of their country of residence apply.
